Environmental risks in real estate transactions are always a concern for property owners, buyers, developers and lenders. This fascinating case study will explore the unique issues encountered in the purchase of an off-street industrial site surrounded by contaminated property along a federal navigable waterway. Attorneys Kevin Bernstein and Lisa Weaver will walk attendees through the environmental and real estate due diligence process implored to identify, analyze and resolve various risks with the site and discuss contract provisions designed to protect buyers, Phase I and II environmental reports, CERCLA issues and other due diligence matters of interest.
