Bryan C. Smith

Bryan helps clients bring their products and ideas to market and protects them through a wide range of intellectual property services. Bryan’s practice includes preparing and prosecuting patent applications, focusing on optical technologies, electrical components, mobile and smart phone applications, imaging devices and mechanical systems. In addition, he conducts patentability, infringement and invalidity studies and reviews and provides guidance on licensing agreements.

IP Litigation

As an experienced intellectual property litigator, Bryan defends patents, trademarks and trade dress. His litigation experience consists of discovery proceedings, including deposition preparation; preparing and responding to written discovery demands; and preparing and filing discovery-related motions, as well as dispositive motion practice and trial preparation. He also has assisted in drafting appeals to the Federal Circuit on patent-related issues.

Post-Issuance Proceedings

Bryan represents both patent owners and petitioners in inter partes reviews (IPRs) and post-grant reviews (PGRs) before the Patent Trial and Appeal Board (PTAB). He has served as lead counsel and has worked on dozens of IPRs involving a broad range of technologies including semiconductors, handheld scanning devices, web technology, and nanofiber based graft materials. 

Patent Procurement

Bryan advises clients in all aspects of patent procurement, including invention disclosure evaluation, application drafting and prosecution. He manages client patent portfolios for a variety of technologies including mechanical, electrical, optical, software, medical and other industrial applications and prepares opinions related to patent validity and infringement.
