Legal issues surrounding the employment of transgender and non-binary individuals are varied and complex. This presentation will provide an overview of the legal landscape under federal law as applicable to matters of gender identity and expression in employment, including:

  • an examination of these issues in light of Title VII;
  • the Americans with Disabilities Act;
  • the Occupational Safety and Health Administration; and
  • the Family and Medical Leave Act.

The presentation will also explore New York law, including:

  • the Gender Expression Non-Discrimination Act;
  • New York Human Rights Law; and
  • New York sexual harassment training requirements.

Topics such as pronoun usage, bathroom access, religious objections and correct terminology will also be addressed. 

This program will offer 1.5 CLE credits in diversity, inclusion and elimination of bias.
