Recent years have witnessed a surge in the number of lawsuits claiming violations of the federal False Claims Act (FCA). The FCA’s unique enforcement provisions create a strong incentive for individuals to bring suit against current or former employers, or other companies and institutions alleging fraud against the government by means of false certifications of compliance, false claims for payment, false statements resulting in payment with U.S. funds, or the improper use of grant monies. The substantial damages and penalties available under the federal and New York FCA statutes can give rise to significant exposure for companies and institutions that receive funding from, or do business with, governmental agencies or their contractors. Litigation of federal FCA cases resulted in recoveries of more than $3.8 billion in 2013 alone, and nearly $39 billion since 1986. Suzanne Galbato and Ed Conan of Bond’s Complex Litigation Practice Group will provide an overview of the evolving FCA litigation landscape, including the FCA’s background, enforcement mechanisms, provisions pertaining to liability, and provisions relating to damages and penalties. The program will also feature an overview of New York’s recently amended False Claims Act. Practical advice will be offered for in-house counsel charged with avoiding liability under the FCA, dealing with employee-relators and government investigators, and defending against FCA claims.
