For many of us, when we hear "Title IX" mentioned we reactively associate it with gender equality in athletics.
While that is certainly a primary emphasis of this Civil Rights law that was enacted in 1972, Title IX prohibits any kind of discrimination against students and employees in federally assisted educational programs.
As a result of new guidelines issued by the U.S. Department of Education, Title IX is receiving significant and growing enforcement activity relative to sexual harassment and sexual violence in public schools across the country, including several districts here in NYS.
The focus of the government's enforcement efforts - as well as private litigation - has been on schools' responsibility to prevent and respond to alleged assaults and harassment.
The complexities of interpreting Title IX continue to increase and the risk of a school board's liability has reached an all-time high.
Christa Richer Cook, an attorney with Bond, Schoeneck & King, will present a short program on what school board members and superintendents need to know about this issue. Her presentation will provide a primer on Title IX, the legal exposure for schools and effective ways to proactively assess your school district's policies, procedures and responsibilities.
