Session One: September 12, 2017

Auditing HR Practices and Procedures to Limit Legal Exposure
Presented by John M. Bagyi, Esq., SPHR, SHRM-SCP

Given the competing demands human resource professionals are subject to on a daily basis, it is easy to neglect to review internal processes and systems to ensure employment practices are legally compliant. However, periodically auditing practices and procedures is essential to identify potential liability and incorporate best practices. In this presentation, John will discuss how to conduct an HR audit and what to look for with regard to hiring, wage and hour, EEO and labor relations practices.

Unique and Challenging ADA Accommodation Issues
Presented by Robert F. Manfredo, Esq.

When it comes to providing accommodations under the Americans with Disabilities Act, most employers are familiar with what to do when an employee requests a simple or routine accommodation. Compliance becomes more challenging when an employee asks for a less common accommodation, or if the issue is related to substance abuse. This presentation will address these less common accommodation requests and challenging issues that arise under the ADA, including fragrance sensitivity and irritant-free environments, parking spaces and commuting assistance, drug and alcohol concerns, including medical marijuana, repeated requests for leave, and disciplining employees who misuse leave.

Managing Performance, Addressing Misconduct and Terminating the Employment Relationship – The Right Way to Do It
Presented by John M. Bagyi, Esq., SPHR, SHRM-SCP

This entire session of the Academy program will be devoted to performance management and progressive discipline from the introductory period through termination of employment. Through a discussion of best practices and common pitfalls, John will explore the difference between managing and evaluating performance, how to prepare and deliver effective performance evaluations, and the appropriate use of performance improvement plans. Recognizing that efforts to address performance and conduct concerns will not always be successful, John will also address how to make and implement the decision to terminate, while limiting legal exposure.
This session will consist of one topic, which will run from 8:30 a.m. to 11:30 a.m.

Cybersecurity and Data Privacy: What Employers Need to Know
Presented by Michael D. Billok, Esq., CIPP-US

The unfortunate side effect of endless news stories about website and data breaches is that it tends to become background noise and invite complacency, when employers should be ever more aware of their obligations of protecting employees’ data—as well as protecting their company or organization’s data from negligent or rogue employees. This presentation will outline employers’ responsibilities when it comes to cybersecurity and data privacy, and what employers can do to minimize the chance of, and be ready for, data breaches.

Ask This, Not That: Best Practices for Screening and Hiring Job Applicants
Presented by Megan M. Collelo, Esq.

Finding the right candidate to fill a position can be an onerous task; ensuring compliance with anti-discrimination laws during the hiring process can be just as burdensome. The failure to observe best practices when conducting interviews, requesting or utilizing background checks, and searching social media can subject employers to legal liability even if the applicant is never hired. This presentation will provide employers with the information necessary to prevent such violations, along with guidance to ensure selection of the best potential employee.
