Bond, Schoeneck & King Attorneys Brian Laudadio and Stephen Sharkey Obtain $754,000 Verdict for Client Magnus Precision Manufacturing, Inc.

In a trial held in Milwaukee, Wisconsin's Waukesha County Circuit Court ending January 25, 2011, Bond, Schoeneck & King attorneys Brian Laudadio and Stephen Sharkey successfully obtained a $754,000 verdict for their New York based client, Magnus Precision Manufacturing, Inc.

Bond, Schoeneck & King represented the plaintiff, Magnus, in a lawsuit against defendants Universal Automatic Corporation and TPS International, Inc. Magnus sought a refund for the purchase price of a machine tool it had purchased from the defendants in 2005.

This highly technical commercial dispute required Bond, Schoeneck & King's attorneys to have a thorough understanding of the machine tool industry, parts manufacturing requirements and process capability studies. In the end, the Court determined that the machine tool in question did not function as represented by defendants, and that Magnus' efforts to modify the machine to make certain parts were not the cause of its failure to produce quality production parts. Rather, Bond, Schoeneck & King proved that the machine's inability to produce good parts was directly caused by inherent machine design flaws and the assembly errors of the defendants.
