Program Summary
In New York, Summer is the time for facility projects that often involve building demolition and With the continuing changes in Immigration Law, employment of foreign born professionals at our academic campuses has become more complex with each passing year. Given the foregoing, the Immigration Law Webinar will cover areas which include: (1) Overview of the current Immigration Law environment; (2) employment of faculty and researchers under the H-1B category; (3) processing for foreign professionals under the North American Free Trade Agreement ("NAFTA"); as well as (4) filing for permanent residency under (a) the Outstanding Professor/Researcher Category; (b) Regular PERM and Special Handling Labor Certification process; and (c) National Interest Waiver requests.

We will also address issues as they relate to Retrogression (backlog in the permanent residency process), Adjustment of Status (the last stage of the permanent residency) process, employment authorizations for dependents, filing fee and processing times, as well as the latest developments with Department of State's PIMS visa processing system.

Speakers
Mark P. Popiel, Esq.

Mr. Popiel represents small to multi-million dollar corporations, professionals, and academic institutions in various permanent and temporary resident matters where he advises his clientele on the proper choice of visas and employment-based immigration categories, governmental procedures, content and format of applications and petitions, as well as a host of other immigrant and nonimmigrant related matters. He has extensive experience in: (1) temporary employment-based cases such as H-1B, L-1, TN, O-1, E-2 and E-3 petitions; and (2) permanent residency cases including PERM Labor Certification Applications, Outstanding Professor/Researcher Petitions, as well as National Interest Waivers and Extraordinary Ability Petitions. Among others, Mr. Popiel formerly served as the Director of Immigration Services (Chief Immigration Counsel) for the State University of New York at Buffalo where he represented foreign faculty, scholars, researchers, and other staff members in the processing of their temporary, as well as permanent residency immigration cases. Mr. Popiel serves as Director, Immigration Law Clinic/Adjunct Instructor at the University at Buffalo Law School where he teaches the Immigration Law Clinic to upper level law students. Among others, Mr. Popiel also serves as an Adjunct Faculty with Hilbert College teaching Immigration Law to undergraduate students.

Jitesh Malik, Esq.
Mr. Malik focuses his practice on business immigration matters and provides strategic immigration planning to address the needs of the U.S. employers in obtaining temporary, nonimmigrant visas for business professionals (including managers, executives, physicians, nurses and computer professionals). Mr. Malik also assists both corporations and individuals in the preparation and submission of employment-based permanent residency matters which include, among others, the EB-1 Outstanding Professor/Researcher Petitions, the EB-2 National Interest Waiver Petitions, PERM Labor Certifications, as well as the EB-5 Investor Petitions. In addition, Mr. Malik also counsels individuals in highly complex immigration matters, which include Motion to Reopen & Reconsider to the U.S. Citizenship & Immigration Services, appeals to the AAO & BALCA and Nunc-Pro-Tunc requests.
