Defending Borrower Defense Claims - Complimentary Webinar

August 25, 2023

By: Seth F. Gilbertson

In spite of a judicially stalled regulatory reform effort, the U.S. Department of Education (DOE) recently released a slew of borrower defense claims. Many colleges and universities were informed that former students had filed complaints accusing the institutions of fraud and various other misdeeds in an effort to get student loans discharged (and recompensed by the institution). The claim notices DOE sends typically give institutions 60 days to respond, so responses to the recent complaints are due in early-to-mid October 2023. Once the ongoing litigation over DOE’s new regulations is resolved, such claims could become even more commonplace.

In this pop-up webinar, we will give you a brief overview of the borrower defense regulations and provide advice for how to respond to claims.
