New York’s Highest Court Grapples with Video Evidence in the Age of ‘Deepfakes’

For this week’s Business in 2026 webinar, Bond litigator Richard L. Weber delivered a presentation about a New York State Court of Appeals case that wrestled with the challenges of evaluating video evidence in the age of artificial intelligence (AI) and “deepfakes.” In Matter of M.S., a family court admitted videos into evidence that allegedly showed child sexual abuse in a family’s home. In a narrowly split decision, however, the Court of Appeals ruled the videos were not properly authenticated. The dissenting judges, meanwhile, took issue with the fact that there were no objections raised during the lower court proceedings as to the videos’ provenance.
