Refresher on COVID-19 Medical Malpractice Litigation

For this week’s Business in 2026 webinar, Bond labor and employment attorney Travis R. Talerico provided an update on the Emergency Disaster Treatment Protection Act (EDPTA) that shielded health care providers in New York State from some medical malpractice claims related to the treatment of COVID-19 in the early days of the pandemic. While the law was repealed in April 2021, it was not repealed retroactively, so there are ongoing cases to which it still applies.
